Legal Update: New Traffic Laws Effective October 1, 2025

In October 2024, Maryland implemented changes to its DUI laws; recently, we explained these updates in a previous blog post. This trend is continuing this year with more changes coming to the roads.

At Ruben Law Firm, we actively keep Marylanders informed about significant legislative changes that may impact our clients. In this blog post we would like to highlight a new change in Maryland’s Transportation Code that will impact Maryland drivers.

Our legislature has passed stricter laws related to reckless, negligent and aggressive driving in Maryland. Beginning October 1, 2025:

  • Reckless driving will no longer be a fine-only offense.
  • After October 1, 2025, if charged with reckless driving in Maryland, you could be facing a maximum penalty that includes 60 days in jail.
  • If the State can prove that you were going 30 miles per hour or more above the posted limit, that will be automatically considered reckless driving.
  • If police charge you with negligent driving, then the state may increase the maximum fine to $750; furthermore, it may add two points—instead of one—to your traffic record.
  • For a charge of aggressive driving, maximum fines will increase to $1,000 and the law expands what qualifies as aggressive driving.
