U.S. House to Vote on Terminating Federal Ban of Marijuana

U.S. House to Vote on Ter…

Last Friday, House Majority Leader Steny Hoyer announced that the U.S. House of Representatives would be voting on terminating the federal ban on marijuana. This would be a landmark vote, as many states across the country faced choices regarding the legalization of the drug for recreational use in their states on election day. The support for legalization of the drug is at an all-time high in the United States, which is why lifting the federal ban on marijuana is on the schedule over the next week.

Many Americans believe that legalizing or at least decriminalizing the drug would not only provide a boost for the economy, but that it would also help protect members of certain minority communities who they believe are disproportionally targeted and incarcerated for possession of the drug.

While this is a landmark vote, as the House has never before voted on lifting the federal ban on marijuana, you should understand that there is no indication the Senate will vote on this matter over the next month. Moreover, with the runoff election in Georgia still in progress, one can reasonably speculate that the outcome of that election may also play a role in the effort to lift the federal ban on marijuana.

Should the drug be descheduled, federal courts will have to expunge prior marijuana convictions and place taxes on marijuana to assist certain communities who have been trying to stymie the war on drugs, among other things. The vote has not yet taken place, and there is no telling whether such a proposal would get passed through the Senate, so it is critical you understand that until then, you can still face marijuana-related charges in Maryland, and if you are currently facing such charges, you must retain the services of an experienced Maryland criminal defense attorney as soon as you can.
