As of October 1, 2024, Maryland has implemented significant changes to its DUI laws, particularly concerning mandatory use of ignition interlock devices (IIDs) after your court case depending on the result of your case.

An IID is a breathalyzer that is installed in your vehicle that requires you to provide a breath sample in order to start your car. Under the revised law, all individuals convicted of or receiving probation before judgment (PBJ) for alcohol-related driving offenses are required to install an IID in their vehicles. This is an expansion from the law previously.

The duration of IID usage varies based on the offender's history:

  • First conviction or PBJ: Required to use the IID for a minimum of six months.
  • Second conviction or PBJ: Must use the device for at least one year.
  • Third or subsequent offenders: Obligated to use the IID for three years.
